These Terms and Conditions ("Terms") govern your use of the TerraSeed LLC website at terraseedllc.com and any hydroseeding, erosion control, or related services we provide. By using our website or engaging us for services, you agree to these Terms.
Service agreements: When you hire TerraSeed for a project, the specific work, price, timing, and scope will be detailed in a written estimate or proposal provided to you separately. That document, together with these Terms, forms your service agreement. If any conflict arises between your written estimate and these Terms, the written estimate controls.
This website is provided for informational purposes. You agree to use it only for lawful purposes and in ways that do not infringe on others' rights or restrict their use of the site. You may not:
All content on this website — including text, photographs, graphics, logos, and the TerraSeed name — is owned by TerraSeed LLC and protected by U.S. copyright and trademark law. You may not use our content, branding, or photos for commercial purposes without written permission.
If you would like to request permission to reference TerraSeed in a case study, news article, or similar context, please contact us.
Free on-site estimates are provided as a courtesy and are not binding until a written quote has been delivered and signed or otherwise accepted by the customer. Estimates are typically valid for 30 days from the date issued unless otherwise stated in writing.
Verbal quotes, website content, and general pricing ranges (for example, "$0.10 – $0.25 per square foot") are informational only and should not be relied upon as a binding offer. Actual project pricing depends on site-specific conditions determined during the on-site walkthrough.
TerraSeed provides hydroseeding, erosion control, slope stabilization, and related services as detailed in each customer's written estimate or proposal. The scope of work for any given project is limited to what is specifically described in that document. Any additional work, site conditions, or changes requested after the quote has been accepted may result in additional charges and require a signed change order.
Unless explicitly stated otherwise in the written estimate, the customer is responsible for ensuring the site is properly graded, cleared of debris, and ready for hydroseed application on the scheduled day. TerraSeed is not responsible for delays, rework, or additional costs caused by improper site preparation by the customer or their other contractors.
Proper watering and care during the establishment period (typically 3 to 6 weeks) is essential for hydroseed success and is the responsibility of the customer unless a separate watering service is specifically contracted. TerraSeed will provide a written care guide with every installation. Failure to follow watering recommendations is the most common cause of poor establishment and is not covered by any workmanship guarantee.
Payment terms will be specified in each project's written estimate. Typical terms include:
Past-due balances may accrue interest at the lesser of 1.5% per month or the maximum rate allowed by North Carolina law. Customers are responsible for any collection costs, including reasonable attorney's fees, incurred to collect overdue balances.
TerraSeed stands behind our workmanship. If a hydroseeded area fails to germinate or establish due to a defect in our application — material quality, application rate, or technique — we will return and reapply at no additional cost, provided:
Our workmanship guarantee does not cover failures caused by:
Hydroseed application is weather-dependent. We may reschedule scheduled application in cases of rain, frozen ground, high winds, or other conditions that would compromise application quality. In such cases, we will communicate proactively and reschedule as soon as conditions allow. We are not liable for delays caused by weather or other conditions reasonably beyond our control.
TerraSeed maintains general liability insurance appropriate to our work. Certificates of insurance can be provided to commercial customers and general contractors upon request.
Limitation of liability: To the maximum extent permitted by law, TerraSeed's total liability for any claim arising from or related to services provided shall not exceed the total amount paid by the customer for the specific project giving rise to the claim. TerraSeed is not liable for incidental, consequential, indirect, or punitive damages, including but not limited to lost profits, construction delays, or loss of use.
TerraSeed may photograph completed projects and use those photos on our website, Google Business Profile, social media, and marketing materials. We do not identify property owners, disclose specific addresses, or publish GPS metadata in these photos. If you prefer that your project not be photographed or published, please inform us at the time of the estimate or in writing before work begins.
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Any legal action arising from or related to these Terms or services provided shall be brought exclusively in the state or federal courts located in Iredell County, North Carolina.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
We may update these Terms from time to time. When we do, we'll change the "Last Updated" date at the top of this page. Continued use of our website or services after changes are posted constitutes your acceptance of the updated Terms.
